Acquisition Procedure

  •   1. The Collector is directed to take proceedings for the acquisition of
     the land
    Preliminary

    Upon the publication of the notification under s 5(1) the Collector will be directed to take proceedings for the acquisition of the land.  See s 6.

   
  •   2. The Collector gives notice of the intended acquisition
    Collector's Notice
    The Collector will give notice that the Government intends to acquire the land and that claims to compensation may be made to him.  See s 8(2).

    The notice will be posted at convenient places on or near the land and will also be given to all persons known or believed to be interested in the land.  See s 8(2).

    The notice will give particulars of the land and will require all persons interested in the land to appear before the Collector on the day and at the time and place specified in the notice and to state:

    • the nature of their interests in the land;
    • the amount and particulars of their claims to compensation;
    • the basis or the mode of valuation of the amount claimed; and
    • their objections, if any, to the measurements of the land made under s 7.  See s 8(3)
  •   3. The Collector holds an inquiry
    Collector's Inquiry
    On the day specified in the Collector's notice (or on any day to which the inquiry is adjourned) the Collector will proceed to inquire into:-

    • the objections to the measurements made under s 7;
    • the value of the land; and
    • the respective interests of the persons claiming the compensation.

    See s 10(1).
  •   4. The Collector makes his award

    Collector's Award

    As soon as possible after the conclusion of the inquiry the Collector will make an award of 

    • the area of the land;
    • the compensation which in his opinion should be allowed for the land; and
    • the apportionment of the compensation among all the persons known or believed to be interested in the land of whom or of whose claims he has any information whether or not they have appeared before him.
