Fees
No fees are payable when an appellant lodges the Notice of Appeal or the Petition of Appeal or of any other document.
Where mechanical recording or verbatim reporting services are required application must be made to the Registrar. Fees and other charges are payable for such services (see Practice Direction No. 3 of 2001).
Costs
1. When will costs be ordered to be paid by the appellant? The costs of the appeal will be paid by the appellant where -
- the amount of compensation awarded by the Board does not exceed the sum awarded by the Collector; or
- the appeal is withdrawn without any agreement being made by the parties as to costs
This is provided by s 32(1) of LAA and an Order to this effect will be made by the Board.
2. When will costs be ordered to be paid by the Collector?
Section 32(2) provides that where the amount of compensation awarded by the Board exceeds the sum awarded by the Collector the costs of the appeal will be paid by the Collector but there are exceptions.
If the claim of the appellant exceeds the amount awarded by the Board by 20% or more he will not be entitled to his costs. This is provided by s 32(4).
The Board also has a discretion to make such order as to costs as it thinks fit where the appellant has made a claim that is excessive or he has been negligent in putting his case before the Collector. Please see s 32(3).
