Withdrawal of Appeal

  •   1. How to withdraw an appeal?
    An Appellant may withdraw his appeal at any time by lodging a Notice of Withdrawal but see the Note below

    Note:
    Before an appeal is withdrawn, there may be questions to be decided with respect to costs, any deposit money or any other relevant matter and an Order or Direction by the Board may be required.
  •   2. Can an appeal be withdrawn without my doing anything?
    Please see s 24 of LAA. If you fail to make the deposit or to authorise the Collector to make it within the time specified under s 23(1)(b) or if your Petition of Appeal is not lodged within the time prescribed by s 23(1)(c) then your appeal is deemed to have been withdrawn.

    The time specified under s 23(1)(b) is 14 days from the receipt of the Collector’s award.

    The time prescribed by s 23(1)(c) is 14 days from the service on you of the Collector’s Grounds of Award.

    The Board may extend the above times on an interlocutory application made to it.
