  •   1. Why is a deposit required?
A person who appeals to the Board is required under s 23(1)(b) of LAA to deposit with the Accountant-General a sum equivalent to one-third of the amount of the award or $5000 (whichever is less) unless he receives a written waiver from the Collector. He may also comply with s 23(1)(b) of LAA by authorising the Collector to make the deposit.
  •   2. What happens to the Deposit?
If the appellant is unsuccessful in his appeal and any costs are ordered to be paid by him the Board may order the costs to be paid from the deposit.

In all other cases the Board may order the deposit or the balance if any after payment of any costs to be re-paid to him.
  •   3. How is the deposit re-paid?
If the Board orders the deposit or the balance (if any, after payment of any costs) to be re-paid then you must complete the GIRO form and lodge it with the Registry. We will process your application. The estimated time needed for a refund to be completed is one month.

If your case concludes other than at a hearing before the Board you will be called to appear before the Board for an order to be made as regards the deposit but the Board may dispense with the appearance of the parties in any particular case.
